What was the case about?

The case involved a married couple from Bosnia and Herzegovina who had been living in Germany for several years. The family’s minor daughter also lived in Germany and attended school there. The woman held a Settlement permit. The man had a temporary residence permit.

Later, however, the authorities began to doubt whether the B1 language certificates the couple had submitted accurately reflected their German language proficiency. In the woman’s case, the court found that she had been certified as having a B1 language level even though she had not previously taken an exam.

In the man’s case, the court took a critical view of the circumstances surrounding the language certificate. According to the court, he had already failed several language exams that took place near his place of residence. A few weeks later, he submitted a certificate from a language school located about 700 kilometers from his place of residence. However, the language school was no longer officially accredited at that time.

The authorities therefore concluded that the couple had provided false information about their German language skills. As a result, the authorities revoked the Settlement permit . They also denied the husband’s application to extend his residence permit. Furthermore, the couple was deported from Germany.

The couple filed a lawsuit challenging the decision. The wife wanted to prevent her Settlement permit from being Settlement permit . She also applied for a residence permit based on family reunification. The husband wanted to have his residence permit extended. Both also wanted to prevent their deportation orders from being upheld.

Furthermore, it was no longer officially accredited. In the court’s view, this suggested that the couple had deliberately used the certificates even though they did not accurately reflect their actual proficiency in German.

The court also emphasized that deportation in such cases can deter others from attempting similar acts of deception.
