What was the case about?

The case involved an Albanian national who has been living and working in Germany since 2018. His wife and their two minor children joined him in Germany in 2019 through family reunification.

In 2023, the man applied for a Settlement permit. As proof of his language skills and integration, he submitted three documents: a certificate of successful completion of an integration course, proof of passing the “Life in Germany” test, and a certificate for the German language test for immigrants.

All three documents turned out to be forgeries. The man was subsequently sentenced to a fine of 60 daily rates for document forgery.

Falsified Documents: What Does Immigration Law Say?

A Settlement permit a permanent Residence permit. To qualify for this status, several requirements must be met, such as sufficient knowledge of German, certain integration efforts, a secure source of income, and contributions to the pension insurance system.

The court therefore deemed the offense a serious violation of public safety and order. This, in turn, justified the decision to deport him.

The fact that the man later submitted genuine certificates did not change the decision. Although the new documents showed that he now possessed the required knowledge, they did not undo the earlier deception and the associated criminal offense.

What does this decision mean for other applicants?
